Terms of service

1. Service description

AutoKap is an automated website screenshot and video capture service, provided by Clément Guérin, sole proprietor (SIRET: 10028571700011), 43 Quai Malakoff, 44000 Nantes, France (hereinafter "AutoKap").

The service allows users to generate screenshots and videos of web pages via a web interface and an API, organize them into projects, and integrate them into their own applications.

Some features of the service use artificial intelligence technologies (page analysis, conversational assistant) provided by third-party providers. Content submitted to these features is sent to these providers for processing.

2. Access to the service

• Access to the service requires creating a user account.
• The service is intended for professional use or development purposes. The user must be of legal age and have the legal capacity to enter into a contract.
• The user is responsible for the confidentiality of their login credentials and CLI keys.

3. Pricing and subscriptions

• AutoKap offers free and paid plans. Current prices are displayed on the website at the time of subscription.
• Payments are managed by Stripe. By subscribing to a paid plan, the user accepts Stripe's terms.
• AutoKap reserves the right to modify its pricing with 30 days' notice by email.
• No refunds are granted for started periods, unless required by law.

4. Acceptable use

The user agrees not to use AutoKap to:

• Capture websites without authorization
• Circumvent protection or access control systems
• Generate an excessive volume of requests that could harm the service
• Any illegal activity or infringement of third-party rights

5. Liability

AutoKap is a technical tool. The user is solely responsible for the URLs they submit and the use they make of the generated captures.

AutoKap commits to providing the service with the reasonable care of a professional, but does not guarantee uninterrupted availability. AutoKap's liability shall not exceed the amount paid by the user during the last 3 months.

6. Intellectual property

The code, interface, and AutoKap brand are the exclusive property of Clément Guérin. Any unauthorized reproduction or exploitation is prohibited.

Screenshots generated via the service belong to the user who commissioned them. AutoKap claims no rights over this content.

7. Termination

• The user may terminate their account at any time from their account settings.
• AutoKap reserves the right to suspend or delete an account in case of violation of these Terms, without notice or refund.

8. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, you have 14 days from the date of subscription to exercise your right of withdrawal, without having to justify any reason.

However, in accordance with Article L221-28, 13° of the French Consumer Code, you acknowledge and agree that the service begins as soon as your subscription is validated. Consequently, you expressly waive your right of withdrawal once the service has been fully performed during the withdrawal period.

If the service has not been fully performed, you may exercise your right of withdrawal by contacting us at hello@autokap.app. A proportional refund will be issued for the unused period.

9. Governing law

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution, the competent courts are those of Nantes.
